ddHiFi User Agreement

Welcome to the products, websites, account system, App, and related services provided by ddHiFi. This Agreement is the basic agreement between you and the ddHiFi service provider regarding your access, registration, login, authorization, product connection, device configuration, saving or sharing of PEQ, viewing firmware updates, submitting feedback, applying for after-sales service, managing accounts, and use of other ddHiFi services.

Please carefully read and fully understand this Agreement and the following supporting documents before using ddHiFi services:

  1. Terms of Use;
  2. Privacy Policy;
  3. Personal Information List;
  4. Third-Party Information Sharing List;
  5. Account and Data Deletion Instructions.

By clicking agree, registering, logging in, authorizing, continuing to access, or otherwise using ddHiFi services, you indicate that you have read, understood, and accepted this Agreement and the above supporting documents. If you do not agree to any of them, please stop using the related services.

1. Scope of Application

This Agreement applies to existing ddHiFi services and related services that may be authorized in the future, including but not limited to:

  1. ddHiFi Link Android App;
  2. ddHiFi unified account center: accounts.ddhifi.com;
  3. ddHiFi official website, product support portal, statement pages, and after-sales service system;
  4. Product connection, USB device identification, parameter configuration, PEQ configuration, firmware update, product manual and FAQ access;
  5. Other ddHiFi services that log in, authorize, or identify users through a ddHiFi account.

If a service has separate page prompts, activity rules, product instructions, after-sales policies, firmware update instructions, or authorization notices, and they are inconsistent with this Agreement, the corresponding special notice shall prevail within the scope of that specific service. Matters not covered will still be governed by this Agreement and the supporting documents.

2. Relationship Between Agreement Documents

This Agreement explains the basic service relationship and overall rights and obligations between you and ddHiFi.

The Terms of Use explain specific rules for access, registration, login, authorization, account management, App use, product connection, PEQ configuration, firmware update, after-sales application, intellectual property, disclaimers, liability for breach, and other use rules.

The Privacy Policy explains how we collect, use, store, protect, entrust the processing of, share, transfer, publicly disclose, and delete your personal information.

The Personal Information List sets out the types, purposes, scenarios, and sensitivity of personal information that may be collected and used in different service scenarios.

The Third-Party Information Sharing List sets out the third-party services, recipients, use scenarios, and information scope for which we may entrust processing, share information, or involve information collected by third parties.

The Account and Data Deletion Instructions explain how you may request deletion of your ddHiFi account and related data, as well as the types of data deleted or retained and processing periods.

For matters involving personal information processing, the Privacy Policy and relevant lists shall apply first. For matters involving account and data deletion, the Account and Data Deletion Instructions shall apply first. For matters involving specific service use behavior, the Terms of Use shall apply first.

3. Service Provider and User Qualification

ddHiFi services are provided, operated, maintained, or supported by Guangzhou DD Electronics Technology Co., Ltd. and its authorized teams, related services, or partners within the necessary scope.

You should have corresponding civil capacity when using ddHiFi services. If you are a minor or do not have full civil capacity, you should use the services with the consent and guidance of your parents or other guardians. Guardians should pay attention to minors’ use of accounts, Apps, product connection, firmware updates, after-sales service, and online services, and bear corresponding guardianship responsibilities.

4. Account, Login, and Authorization

Some ddHiFi services may require login with a ddHiFi account or user identity recognition. A ddHiFi account may be used for the ddHiFi Link Android App, unified account center, official website, after-sales service, product support portal, and other ddHiFi services that may be authorized in the future.

The ddHiFi Link Android App currently completes SSO login through the unified account center. During login, you may be redirected to the account center page and returned to the App according to the authorization process. You must ensure that information provided during login, authorization, and account use is true, accurate, complete, lawful, and valid, and properly safeguard your account, password, verification code, login device, and authorization status.

Without our consent or the consent of the account rights holder, you must not steal, impersonate, transfer, lend, rent, sell, or share an account. You are responsible for consequences caused by your failure to properly safeguard account credentials or your voluntary disclosure of identity verification information, except where otherwise provided by laws and regulations or where it can be proven that the issue was caused by us.

5. Product Connection, PEQ, and Firmware Updates

The ddHiFi Link Android App may be used to connect and manage supported ddHiFi USB audio devices, providing device identification, parameter configuration, PEQ configuration, local saving, cloud saving, downloading, application, product material access, firmware update, and other functions. Specific available functions depend on product model, firmware version, App version, phone system, connection status, and regional service configuration.

When you adjust device parameters, save PEQ, apply configurations, or perform firmware updates through the App, you should confirm that the relevant operations comply with product instructions and page prompts. During firmware update, please keep the device connection, battery level, network, and App running status stable. Do not disconnect without authorization, close the App, restart the device, or use unofficial firmware, tools, cables, or modified system environments.

You are responsible for product abnormalities, unavailable functions, data loss, or other losses caused by failure to follow prompts, use of unofficial firmware or tools, unauthorized disassembly or modification, cracking communication protocols, forcefully interrupting firmware updates, or similar reasons, except where otherwise provided by laws and regulations or where it can be proven that the issue was caused by us.

6. User Content and Feedback

When using functions that allow submission of content such as PEQ cloud saving, comments, favorites, feedback, after-sales service, or other functions, you must ensure that submitted content is true and lawful and does not infringe others’ intellectual property rights, privacy rights, reputation rights, personal information rights, or other lawful rights and interests.

You must not publish, upload, submit, or disseminate information containing illegal or non-compliant content, infringement, fraud, malicious code, false information, illegal marketing, content damaging brand reputation, or other harmful content. If you violate this Agreement or related rules, we have the right to take measures based on the specific circumstances, such as deleting or blocking content, restricting functions, suspending services, freezing accounts, canceling authorization, canceling accounts, or pursuing liability in accordance with law.

For PEQ configurations, comments, nicknames, avatars, and other content that you voluntarily upload or make public, you grant ddHiFi the right to use, copy, store, display, and disseminate such content within the scope necessary to provide, display, distribute, maintain, review, and improve related services. You still retain other rights you lawfully enjoy.

7. Basic User Obligations

When using ddHiFi services, you must comply with laws and regulations, this Agreement, supporting documents, page prompts, product instructions, and service rules, and must not engage in illegal conduct, infringement, fraud, malicious registration, API abuse, destruction of system security, interference with normal operation of products or services, or conduct that harms the lawful rights and interests of ddHiFi, other users, or third parties.

Without our written consent, you must not reverse engineer, decompile, crack, tamper with, attack, crawl, make bulk calls to, bypass access control of, commercially exploit, or otherwise use the App, website, APIs, account system, firmware, communication protocols, verification codes, security mechanisms, databases, or data beyond normal use purposes.

8. Service Changes and Termination

We may update, adjust, suspend, or terminate some or all functions of ddHiFi services based on business development, product adjustment, system maintenance, security requirements, laws and regulations, app store policies, third-party service changes, or other reasonable reasons.

We will make reasonable efforts to ensure stable and available services, but do not guarantee that all services will be uninterrupted, error-free, or fully meet your specific needs at any time, in any region, on any device, in any network environment, or for any product model.

You may apply to delete your account and terminate use of account-related services according to the Account and Data Deletion Instructions. After account deletion is completed, you may no longer be able to use App login, cloud PEQ, feedback record query, after-sales system, product registration, warranty data management, or other unified account services that rely on that account.

9. Intellectual Property

Text, images, audio, video, trademarks, logos, product names, interface design, program code, databases, technical documents, page structures, App, firmware, service processes, and other content in ddHiFi services are protected by intellectual property laws and regulations and belong to us or the relevant rights holders.

Without written authorization from us or the relevant rights holders, you must not use, copy, modify, reprint, disseminate, display, sell, license, reverse engineer, or otherwise exploit the above content without authorization. If you violate this clause, you shall bear corresponding liability in accordance with law.

10. Privacy and Data Protection

We value personal information protection and will process your personal information in accordance with the Privacy Policy, Personal Information List, Third-Party Information Sharing List, Account and Data Deletion Instructions, and relevant laws and regulations.

You may learn from the above documents what information we collect and use, with which third parties we share information or entrust processing, how we protect information, how to apply for account and data deletion, and how to contact us to exercise rights related to personal information.

11. Disclaimer and Limitation of Liability

To the extent permitted by law, we will not be liable for corresponding compensation for service abnormalities, connection failures, data abnormalities, authorization failures, notification delays, or other impacts caused by network failure, system maintenance, device compatibility, USB authorization failure, device connection abnormality, third-party service abnormality, operating system restrictions, force majeure, hacker attacks, malicious programs, changes in laws, regulations, or policies, and other factors beyond our control.

ddHiFi products and related Apps are mainly used for consumer audio product connection, configuration, and usage support, and should not be used in medical, rescue, industrial control, aviation, traffic safety, life support, or other high-risk scenarios.

12. Agreement Updates

We may update this Agreement according to changes in laws and regulations, business adjustments, product updates, data processing changes, app store requirements, or regulatory requirements. The updated Agreement will be published on the official website, App, account center, or other reasonable location, and will indicate the latest update date or effective date.

If updates involve your material rights and interests, we will prompt you through page prompts, pop-ups, email, or other reasonable means. After the updated Agreement takes effect, if you continue to use ddHiFi services, you will be deemed to have accepted the updated Agreement.

13. Applicable Law and Dispute Resolution

The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws and regulations of the People’s Republic of China.

Any dispute arising from this Agreement or ddHiFi services shall first be resolved by friendly negotiation between the parties. If negotiation fails, either party has the right to file a lawsuit with the people’s court having jurisdiction at the company’s domicile.
